Terms and Conditions of Sale and Service

Purchases of products or services made on pixartprinting.ie (the “Website”) are governed by the following terms and conditions (the “Conditions”).

By clicking the “accept” button, the user (the “User”) accepts these Conditions without limitation or reservation. The Website is owned by Pixartprinting S.p.A. with a sole shareholder, subject to management and coordination by Cimpress plc, with its registered office at Via 1º Maggio 8, 30020 Quarto d’Altino (VE), Italy, VAT number IT04061550275 and Tax Code 04061550275 (“Pixartprinting”).

 

1. Services offered on the Website

1.1 The Website provides web‑to‑print services (collectively the “Services”), including the custom printing of content (which does not include, as further specified below, any editorial services or checks for potential infringements of third‑party rights), in various formats and on different media (the “Products”), with home delivery by postal and courier services within Ireland, save for specific cases to be agreed from time to time. Unless expressly stated otherwise, these Conditions apply to all Services offered by Pixartprinting. Pixartprinting may entrust the performance of the Services to third‑party subcontractors or sub‑suppliers.

1.2 To access the Services, Users must register on the Website in the dedicated User area. During registration, Users will be asked to specify whether they intend to register and make purchases as a company, a sole trader/freelance professional, a private individual or an association, or as a public body. Only purchases of Services made by Users who are natural persons (“Consumer Users”) acting for private purposes, unrelated to their trade, business or profession, will be subject to the applicable consumer protection rules under Italian Legislative Decree no. 206 of 6 September 2005 (the “Consumer Code”), without prejudice to any more favourable mandatory provisions in the Consumer User’s country of residence, including, where applicable, the rights and remedies available under the Consumer Rights Act 2022 in Ireland.

The login credentials created to access the Website may also be used to register on the website www.gifta.com (the “Gifta Website”), which is also operated by Pixartprinting S.p.A., unless the User chooses to use different credentials for the Gifta Website by using a different email address from the one used for their initial registration. Registration on the Gifta Website is entirely optional.

1.3 All final product prices displayed on the Website are given in Euros and can be viewed with or without VAT, depending on the country or registration type. The prices of the Services are subject to periodic changes and variations. Shipping costs are considered to be included in the price for certain Products and offers. For all other Products, shipping costs are to be paid by the User.

 

2. Product selection, orders and purchasing process

2.1 The information and details on the Website do not constitute an offer by Pixartprinting; they are an invitation to Users to place an order. The User’s offer to purchase Products is made when the User submits the online order form at the end of the ordering process described on the Website and below.

2.2 Once logged in, the User may select Products as described in the relevant sections of the Website, selecting each Product, customising it where available, and adding the desired quantities to their shopping basket.

2.3 Any image accompanying a Product description is for illustrative purposes only and may not accurately reflect the Product’s characteristics, including colour, size or any accessories shown. Technical information provided in support of a purchase is supplied by Pixartprinting and/or any third‑party manufacturer and is indicative, generic information only.

2.4 Unless the User chooses images or designs suggested by Pixartprinting for certain Products, once the quotation has been confirmed and payment completed (except in the case of cash on delivery or bank transfer, where available), the User must complete the order by uploading, in the “Upload Area”, the file containing the content to be printed.

2.5 If technical issues prevent the User from uploading files in the “Upload Area”, the User may use third‑party file‑sharing services to share the files with Pixartprinting. Pixartprinting will keep evidence of receipt of the file. The User represents and warrants that they hold all rights required to use the content uploaded via any external file‑sharing service and that such content does not infringe any third‑party intellectual property rights and does not cause damage to any person’s image, honour, reputation or moral integrity, or any other financial or non‑financial loss, as a result of printing the images or content they upload.

2.6 The User is solely responsible for the content, spelling and artwork of the files uploaded.

2.7 After selecting the desired items, an order summary page will show the costs and total price for all selected Products and/or Services, including any applicable delivery charges and taxes. Where the country of delivery of the Products accepted by Pixartprinting is different from Ireland, the total costs and charges – excluding any customs duties, where applicable, which will be imposed directly by the competent customs authority – may be updated during checkout.

2.8 Once the order has been submitted, the User will receive an order confirmation email setting out the Products ordered, the price of each Product, applicable taxes, delivery costs and the payment method chosen. A binding contract is formed when Pixartprinting sends the order confirmation email to the address provided by the User when registering on the Website. Notwithstanding the foregoing, the parties expressly agree that, without prejudice to the time at which the contract is concluded, ownership of the Products will pass from Pixartprinting to the User upon their handover to the courier, as set out in clause 8.

2.9 Pixartprinting may, at its discretion, decline any order, in whole or in part, for example where:

- the information provided by the User in the order form is incomplete or incorrect;

- the User does not meet the requirements for the chosen payment terms;

- the Products ordered are unavailable.

In such cases, Pixartprinting will notify the User by email that the order has not been accepted, in whole or in part, stating the reasons, and no contract will be formed. Pixartprinting will refund any sums already paid by the User in respect of the rejected order.

2.10 Pixartprinting will keep an electronic copy of the contract. Users may access it via their personal My Account area or by emailing support@pixartprinting.com.

 

3. Payment

3.1 Users may purchase Services online and pay using the payment methods made available on the Website, following the instructions provided during the order process.

Payment details will be transmitted, using encrypted protocols, to the payment service provider engaged by Pixartprinting to process remote electronic payments. No third party will have access to such information. All orders must be paid in advance and the selected items will only be sent to production once payment has been received and a compliant “print‑ready” file has been uploaded by the User.

3.2 For bank transfer payments, production will start only once the payment has been credited to Pixartprinting’s account and delivery may therefore be delayed by the approximate period indicated during the order process. The revised indicative delivery date will be notified to the User by email. For bank transfer payments, the User must quote the order number in the payment reference so that the payment can be identified.

For cash‑on‑delivery payments (where available), the order will move straight to production once a compliant “print‑ready” file has been uploaded. This payment method does not affect delivery times. Invoices will be issued when the goods are dispatched. Pixartprinting may, at any time and at its discretion, decline to accept cash‑on‑delivery as a payment method, including where required to comply with applicable legal limits; in such cases, Pixartprinting will promptly contact the User to agree an alternative method of payment.

3.3 Invoices will be made available to the User in a dedicated section of their My Account area on request. Users are responsible for accessing this area, printing their invoice and retaining it in accordance with applicable law.

3.4 Product prices do not include delivery charges, which – where payable – are borne by the User and calculated during the Website checkout process, as described in clause 2.7.

 

4. User responsibilities

4.1 The selection of content and images to be printed, the obtaining of any permissions required for their reproduction, and the use of any personal data relating to recipients are all the sole responsibility of the Users.

4.2 Pixartprinting has no responsibility for the unauthorised use of images or other content by Users or for any infringement of third‑party rights relating to such content.

The User is solely responsible for all consequences of uploading content and images to be printed onto the Website. The User represents and warrants that they have checked and hold all necessary permissions, licences, rights and/or authorisations to upload such content to the Website and use it within the scope of the Services, including for print. Pixartprinting accepts no responsibility for such content or for the confidentiality, use, publication and/or disclosure of it.

The User therefore agrees to indemnify and hold Pixartprinting harmless from and against any liability, loss, damage, cost or expense (including reasonable legal fees) which Pixartprinting may incur in connection with any third‑party claim relating to alleged infringement of intellectual property rights, damage to image, honour, reputation or moral integrity, or any other financial or non‑financial loss arising from the printing of images or content uploaded by the User, or from the use of personal data and/or the receipt of Products by the recipients of the Services.

4.3 The User confirms that they are aware of and will comply with the technical specifications on the Website relating to the composition and permitted use of the materials from which the Products are made. The User accepts full responsibility for any failure to comply with those specifications and agrees to indemnify and hold Pixartprinting harmless from and against any liability, loss or damage (including financial and non‑financial loss) arising out of any misuse of the Products or use that does not comply with such specifications by the User or any third party.

4.4 The User declares that they are aware of the obligations concerning (i) the environmental labelling of packaging and (ii) the marking of single-use plastic products under Directive (EU) 2019/904 and Implementing Regulation (EU) 2020/2151, as transposed by the legislation applicable in the User’s country. Pixartprinting makes available on its Website, for each type of material, the information relating to environmental labelling (reproduction of the pictogram with indication of the relevant code), thereby providing the User with adequate information. Accordingly, the User (a) undertakes to comply fully with the applicable legislation in the use and marketing of the Products, ensuring that the content and images to be printed bear the correct and necessary references; (b) assumes all responsibility in this regard; and (c) indemnifies and holds Pixartprinting harmless from any liability, damage (pecuniary or non-pecuniary), cost or penalty arising from breach of such legislation.

4.5 Pixartprinting does not review content uploaded by Users other than to check its technical compatibility with the required specifications. Pixartprinting reserves the right, at any time, to suspend or cancel any order where the content is, or appears to be, defamatory, obscene, discriminatory, violent, unlawful or otherwise contrary to public policy or accepted standards of decency.

 

5. Automatic file check

5.1 Pixartprinting’s system automatically checks uploaded files for compatibility with the required format, dimensions and the minimum required resolution threshold, and for the presence of non‑embedded fonts; it checks such fonts and converts them into paths, checks for any white overprinting or knockout, and converts Pantone colours to the most suitable profile for the requested print job (the system does not indicate Pantone colours present in the file but converts them directly to CMYK). The system does not check for possible infringements of third‑party rights.

5.2 If a file is not compliant, the system will block the order. In this case, the User will be notified by email and asked to upload a new file, which may delay the delivery date. Clause 8.3 below remains unaffected.

 

6. Professional file check (PRO File Check & Fix)

6.1 At the User’s request and for an additional fee, by selecting the “PRO File Check & Fix” option, Pixartprinting will carry out a professional file check to verify that the file’s specifications are compatible with the print job requested.

If the User selects this option, Pixartprinting will check: artwork layers, cut paths, safety margins, the distance of graphic elements from the edge of the print, the orientation of front and back, whether the .pdf file meets any specific requirements for magazines and/or catalogues (such as spine width, page count and cover file), and whether the graphic settings are correct where the print requires folding.

The professional file check does not include an exhaustive layout review, spell‑check or checks for missing images inside magazines, catalogues or books.

 

7. Designer (Extended Design Experience – DEX) – AI Service

7.1 Pixartprinting provides a technological solution which, based on specific instructions given by the User (“prompts”), generates one or more images (“output”) using an artificial intelligence system (the “AI Service”). The User acknowledges that the technology used to provide the AI Service is owned by third‑party suppliers and not by Pixartprinting, and that Pixartprinting does not warrant the originality, creativity or uniqueness of any images generated. The User agrees (i) not to use the AI Service to generate content that is unlawful, offensive, infringes intellectual property rights or is otherwise inappropriate, and (ii) not to include in prompts any personal or sensitive data, such as medical information, payment data or similar, or any information or images that are contrary to law or public policy. Pixartprinting may, at its discretion, refuse, suspend or cancel any order that does not comply with these terms of use of the AI Service.

The User is solely responsible for their use of the AI Service, including the choice of prompts and the subsequent use of the generated images, and agrees to indemnify and hold Pixartprinting harmless from any claim, damage, liability, cost or expense (including reasonable legal fees) arising from use of the AI Service in breach of these Conditions or applicable law. In accordance with Article 50 of Regulation (EU) 2024/1689 (the AI Act), Pixartprinting will inform the User that images generated by the AI Service have been produced using an artificial intelligence system; synthetic visual content generated may be technically watermarked where required. Ownership of rights in the outputs generated is governed by the licence terms in the Design Services Special Conditions. Any personal data contained in prompts will be processed in accordance with the Privacy Policy available on the Website.

 

8. Delivery and shipping

8.1 The Products will be delivered on the dates selected by the User during the order or quotation process, as adjusted based on the delivery address in Ireland at the time of order confirmation.

8.2 As Products are delivered by third‑party couriers, delivery times are indicative only and may be affected by delays caused by logistics operators and/or events outside Pixartprinting’s reasonable control. We remain responsible for the goods until they are delivered to you. If we fail to deliver the Products within a reasonable time, you may have statutory rights to terminate the contract or to receive a price reduction; nothing in these Conditions affects those rights.

8.3 An order is not complete until the User has uploaded a compliant “print‑ready” file and payment has been received by Pixartprinting. If the User does not upload a compliant “print‑ready” file and pay for the order within 15 days of the order date, the order will be cancelled. Where a file is non‑compliant, the order will be cancelled if a replacement file is not uploaded within 15 days.

8.4 Subject to clause 8.3, shipping and delivery will take place within the timeframes selected in the quotation, provided that the order is completed (including upload of the compliant file and payment) by 19:30 on the same day, or by 10:30 for next‑business‑day delivery. Files or payment confirmations received after 19:30/10:30 will be treated as received on the next working day.

Pixartprinting does not deliver to trade fairs. The User expressly acknowledges that, should they nevertheless choose to use a delivery address at a trade fair or exhibition venue, no delay or issue attributable to the carrier may be charged to Pixartprinting.

For the purposes of these Conditions, “working days” means Monday to Friday, excluding public holidays in Ireland (or, if the delivery address is outside Ireland, public holidays in the place of delivery).

8.5 Pixartprinting will not be liable to Users who are not Consumer Users for any loss or damage resulting solely from delayed delivery where delivery is performed by third‑party couriers, except where such delay is caused by Pixartprinting’s failure to exercise reasonable care and skill. For Consumer Users, Pixartprinting’s liability for delay is limited only as permitted under applicable consumer protection law, and nothing in these Conditions limits or excludes your statutory rights.

8.6 For Users who are not Consumer Users, the risk of loss or damage to the Products passes to the User when the Products are handed over to the courier. For Consumer Users, risk passes when the Products are delivered to the Consumer User or to a third party nominated by the Consumer User, other than the courier, unless the Consumer User has chosen a courier option not offered by Pixartprinting, in which case risk passes when the Products are handed over to that courier, in accordance with article 63 of the Consumer Code and, for Consumer Users resident in Ireland, the corresponding provisions of the Consumer Rights Act 2022 (Ireland).

 

9. Right to cancel (Consumer Users)

9.1 Consumer Users have the right to cancel the contract, without penalty and without giving any reason, within 14 days of the date on which they (or a third party nominated by them, other than the courier) receive the Products, or, in the case of multiple Products ordered in a single order and delivered separately, the last of those Products. This right arises under articles 52 et seq. of the Consumer Code and, for Consumer Users resident in Ireland, under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013).

9.2 To exercise their right to cancel referred to in clause 9.1, the Consumer User must inform Pixartprinting of their decision within the 14‑day period by sending a written notice to Pixartprinting S.p.A. with sole shareholder, Via 1º Maggio, 8, 30020 - Quarto d’Altino (VE), Italy, or by emailing (support@pixartprinting.com) using the model cancellation form made available on the Website at this link.

The right to cancel may also be exercised online using the relevant form: Submit a request

9.3 If the right to cancel is exercised, the Consumer User must return the Products to Pixartprinting at the above address without undue delay and in any event within 14 days of notifying Pixartprinting of the cancellation. The deadline is met if the Products are sent back before the 14‑day period has expired.

9.4 The Consumer User is responsible for the direct cost of returning the Products, unless Pixartprinting has explicitly agreed otherwise.

9.5 The Consumer User must return the Products in an undamaged and resalable condition. Products must be carefully packed so that the original packaging is not damaged, written on or labelled. The Consumer User is liable for any diminished value of the Products resulting from handling other than that which is necessary to establish the nature, characteristics and functioning of the Products.

9.6 Provided the right to cancel has been validly exercised, Pixartprinting will refund all payments received from the Consumer User for the Products, including the standard cost of delivery (but excluding any supplementary costs if the Consumer User chose a type of delivery other than the least expensive standard delivery offered by Pixartprinting), without undue delay and in any event within 14 days of the date on which Pixartprinting is informed of the Consumer User’s decision to cancel. Pixartprinting may however withhold the refund until it has received the Products back or the Consumer User has supplied evidence of having sent them back, whichever is earlier. Refunds will be made using the same method of payment used for the original transaction, unless the Consumer User expressly agrees otherwise and provided that they do not incur any fees as a result.

9.7 The right to cancel does not apply to Products that are made to the Consumer User’s specifications or are clearly personalised, including Products printed with content or images selected and uploaded by the User (article 59(c) of the Consumer Code; for Consumer Users resident in Ireland, the corresponding exemption for goods made to the consumer’s specifications or clearly personalised under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013)). However, the User may cancel the order up until the time they upload the print file in the dedicated area or until Pixartprinting begins processing the order, whichever occurs first.

 

10. Liability – product defects

10.1 The User acknowledges that Products offered on the Website may be manufactured either by Pixartprinting or by third‑party manufacturers. In relation to third‑party Products, Pixartprinting acts only as a reseller and not as the manufacturer. Products manufactured by Pixartprinting are subject to the guarantees set out in these Conditions and in any applicable product documentation.

For third‑party Products, characteristics such as quality, description, type, quantity, functionality, compatibility, interoperability, fitness for purpose, accessories, instructions (including installation and support) and updates are as stated by the manufacturer in the relevant documentation. Without prejudice to any rights which cannot lawfully be excluded, Pixartprinting does not provide any additional guarantee in respect of such Products beyond those given by the manufacturer.

Third‑party Products may be covered by a manufacturer’s commercial guarantee (if provided), under the terms and conditions set out in the documentation supplied with the Product. To obtain service under such guarantee, the User must keep their proof of purchase (receipt or invoice) and follow the procedures indicated by the manufacturer or authorised service centres. If, after inspection by an authorised service centre, the defect is found not to be covered by the manufacturer’s guarantee, the User may be charged the costs of inspection, repair and transport.

10.2 On delivery, the User must carefully inspect the Products received. Any defects, printing errors or damage to the Products or their packaging that are not attributable to the User must be reported immediately to the courier or to Customer Service. The Products should be accepted with a signature “subject to inspection” where appropriate. The User must then submit a complaint, including photographic evidence where requested, within 8 days of receipt of the Products. This 8‑day time limit applies only to Users who are not Consumer Users; Consumer Users may report lack of conformity within the time limits provided under applicable consumer protection law, and this clause does not affect those rights.

Pixartprinting will use reasonable endeavours to respond to complaints within 24 (twenty‑four) hours.

10.3 Certain Products supplied by Pixartprinting are designed to be suspended or fixed to load‑bearing structures (for example, ceilings or beams). In some cases, a fixing system is supplied with the Product; in other cases, it must be purchased separately. Pixartprinting does not provide installation or assembly services. Installation and fixing are the sole responsibility of the User and must be carried out only by suitably qualified personnel in compliance with applicable health and safety regulations and instructions. The User must check in advance the load‑bearing capacity and suitability of the structures used for fixing, and carry out any technical assessment necessary to prevent the risk of falling or collapse. Pixartprinting has no liability for any damage to persons or property arising from improper installation, unsuitable fixing, use of accessories that are not appropriate for the characteristics of the load‑bearing structure or failure to observe safety instructions, except where such damage is caused by Pixartprinting’s failure to exercise reasonable care and skill or by a defect in the Products.

For Users who are not Consumer Users, purchase of such Products constitutes acceptance of this allocation of responsibility and a waiver of any claim against Pixartprinting in relation to installation or fixing of the Products. For Consumer Users, this clause applies only to the extent permitted by applicable consumer protection law and does not exclude or limit any rights relating to foreseeable loss or damage caused by Pixartprinting’s negligence.

10.4 Nothing in these Conditions limits or excludes Pixartprinting’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

10.5 Subject to clause 10.4, Pixartprinting will not be liable to Users who are not Consumer Users for any loss or damage arising from or in connection with defects in the Products and/or printing errors, except in cases of wilful misconduct or gross negligence.

10.6 In the event of printing errors that are not attributable to the User, Pixartprinting’s primary obligation will be to carry out one reprint of the affected material. Where a reprint is not possible or would not be an appropriate remedy in the circumstances, Consumer Users may be entitled to alternative remedies such as a price reduction or a refund, in accordance with their statutory rights.

10.7 Consumer Users have the benefit of any statutory rights and remedies that apply under mandatory consumer protection law in their country of residence in relation to lack of conformity of the Products, including, where applicable, the right to repair or replacement, a price reduction or termination of the contract. For Consumer Users resident in Ireland, this includes the rights under the Consumer Rights Act 2022 (Ireland) requiring goods to conform with the contract (including as to quality, description and fitness for purpose), together with the associated remedies (repair or replacement, price reduction and the right to end the contract, including the right to end the contract within 30 days). Nothing in these Conditions is intended to exclude or limit those rights.

 

11. Governing law and jurisdiction – alternative dispute resolution

11.1 These Conditions and any orders placed under them are governed by Italian law. However, if you are a Consumer User, you will also benefit from any mandatory consumer protection rules of the law of your country of habitual residence, by virtue of Article 6 of Regulation (EC) No 593/2008 (Rome I); for Consumer Users resident in Ireland this includes the mandatory protections of Irish consumer law, and nothing in these Conditions affects those mandatory rights.

11.2 Any dispute arising out of or in connection with these Conditions or any order placed under them will be subject to the jurisdiction of:

- the courts of Venice (Italy), where the purchase is made by a User who is not a Consumer User; or

- the courts of the place where the Consumer User is resident, where the purchase is made by a Consumer User. If you are a Consumer User resident in Ireland, you may bring proceedings in the courts of your country of residence, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis).

11.3 Nothing in these Conditions affects a Consumer User’s right to bring proceedings before the competent court. Where available, Consumer Users may also seek to resolve disputes out of court through alternative dispute resolution (ADR). Pixartprinting is not currently required to use, and does not commit to using, any particular ADR body; information on ADR options is available from the relevant national consumer authorities and consumer organisations.

12.1 For further information or assistance regarding the Website, placing orders through the Website or orders generally, Users may contact Pixartprinting’s Customer Service by emailing support@pixartprinting.com, by writing to Pixartprinting S.p.A. with sole shareholder, Via 1º Maggio, 8, 30020 - Quarto d’Altino (VE) - Italy, or, where available, by certified email (PEC) to pixartprinting@legalmail.it.

 

13. Changes to these Conditions

Pixartprinting may amend these Conditions from time to time at its discretion. Any updated version will take effect from the date it is published on the Website and will be available in the dedicated section. Each order will be governed by the version of the Conditions in force at the time the order is placed.

 

Design Services Special Conditions

1. As a preliminary service to any purchase of one or more Products under the Terms and Conditions of Sale and Service, the registered User may request from Pixartprinting, for a fee, a graphic design service (the “Design Service”), consisting, as further specified below, of the modification or the creation from scratch of graphic files intended for printing. The Design Service is provided as follows:

1.1 The User must first contact Pixartprinting’s Design Service by clicking the “Design Services” button on the Website and completing the relevant online form, in order to choose between the two types of Design Service offered:

• modification, reworking or correction of one or more existing items of content uploaded by the User to the Website (“Editing Design Services”);

• creation of new content from scratch (“Creation Design Services”).

Unless the User indicates otherwise, in order to perform the chosen Design Service, the User will be contacted at the email address or telephone number provided by them when registering on the Website. In the online form, the User must indicate how they prefer to be contacted by the Design Service. Without prejudice to the foregoing, in order to provide the Design Service more effectively, Pixartprinting may arrange screen‑sharing sessions with the User via “Zoom” (or similar applications), with the camera switched off. The User must describe their project in as much detail as possible, including at least the following information: the exact text and the design specifications they would like incorporated into the design, such as the colours, style, effect and size of the desired Product.

Depending on the type of Design Service chosen, the User may also send reference images in PDF, GIF, AI, PSD, JPG or TIFF format (as a reference, in the case of Creation Design Services, or as content to be further developed or incorporated by Pixartprinting, in the case of Editing Design Services).

1.2 The User must then pay the fee using the various payment methods indicated on the Website and following the instructions for the purchasing process. The fee must be paid in advance upon completion of the online form; the User will be contacted by the Design Service only after the fee has been paid and the online form completed.

1.3 Based on the information provided by the User, once a request for one of Pixartprinting’s Design Services has been started, the User will receive at their email address, respectively:

• a modified or reworked graphic proposal, where the User has chosen the Editing Design Service;

• up to two new graphic proposals (from which the User must choose the new graphic proposal to be printed), where the User has requested the Creation Design Service.

1.4 The Design Service includes, for its entire duration, a maximum of three revisions by Pixartprinting’s designer of the graphic proposal sent to and chosen by the User, based on the User’s feedback. The service is available for a maximum period of 30 days from the initial request. It is understood that, upon the User’s acceptance of the graphic proposal or, failing that, once the third revision by the Design Service has been completed, Pixartprinting’s obligations in this respect will be deemed discharged.

1.5 If the User decides to proceed with printing the graphic proposal created by the Design Service, they may place one or more orders by uploading the content to be printed in the “Upload Area”, and the order will be subject, for anything not provided for herein, to the Terms and Conditions of Sale and Service, of which these Special Conditions form an integral part.

2. As the Design Service involves activities that are also artistic in nature, the obligations assumed by Pixartprinting in this respect are obligations of means and not of result; accordingly, Pixartprinting cannot be held liable for the User’s dissatisfaction once the three revisions have been carried out, it being understood that Pixartprinting will do everything commercially and reasonably possible, within the limits expressly set out in these Special Conditions and in the Terms and Conditions of Sale and Service, to meet the User’s requests.

3. The User acknowledges that, in producing the graphic proposal, Pixartprinting does not carry out any prior‑art search and/or check as to whether the content uploaded by the User has already been created or is in use by third parties. Pixartprinting therefore does not guarantee either the originality or the exclusivity of use of the artwork produced by the Design Service. The User further acknowledges that such prior‑art searches and/or checks are expressly excluded from the Services.

Where reworking of content is requested through the Design Service, the User is solely responsible for all consequences of uploading the content and images to be modified, reworked and printed through the Services offered on the Website. Pixartprinting accepts no responsibility for such content or for its confidentiality, use, publication and/or disclosure. For the purposes of using the content uploaded by the User for the Design Service, the User represents and warrants that they hold the permissions, licences, rights and/or authorisations necessary to use it within the scope of the Services. The User further warrants that they will not upload to the Website any material subject to third‑party proprietary rights without a licence or the prior authorisation of the owner of those rights.

For the Creation Design Service, Pixartprinting may make use of content (for example, graphics, images and fonts) available in limited quantities from third‑party databases, which Pixartprinting may use under specific licences. For each item of content so created by Pixartprinting, the User will have a personal, non‑exclusive, non‑transferable and in any event non‑sublicensable licence to use it, limited to the uses contemplated by the web‑to‑print Service. In this regard, the User acknowledges that the content generated by Pixartprinting’s operators may be similar to other content generated for other Users who have used or will use the same Design Service.

4. In any event, Pixartprinting reserves the right to block and, where appropriate, cancel the work where it considers that the file received from the User and/or the graphic content requested contains defamatory or violent content, or content otherwise contrary to public policy and accepted standards of decency, or unlawful content.

5. The selection of the content and images to be printed, and the obtaining of any legal authorisations required for their reproduction where necessary, remain the sole responsibility of the Users. Pixartprinting cannot in any way be held liable for the unauthorised use of images by Users or for any infringement of third‑party rights in them. The User therefore expressly releases Pixartprinting from, and agrees to indemnify and hold it harmless against, any liability towards third parties claiming infringement of intellectual property rights, damage to image, honour, reputation or moral integrity, or any other financial or non‑financial loss arising from the printing of the images and content uploaded by the User.

6. Save as otherwise provided in these Special Conditions, the Design Service is subject to Pixartprinting’s Terms and Conditions of Sale and Service. Without prejudice to the foregoing, pursuant to article 59(a) of the Consumer Code, the User’s right to cancel is excluded once the Design Service has been fully performed by Pixartprinting. For Consumer Users resident in Ireland, the corresponding position applies under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013), where the consumer has requested performance during the cancellation period and acknowledged that the right to cancel would be lost once the service is fully performed.
